If they have other lawsuits in the pipeline, then they still have a chance. Appeals from the US district court in CO goes to the 10th Circuit in Denver which is where Gorsuch came from and as a SCOTUS justice he oversees that circuit. The 10th Circuit covers CO, KS, NM, OK, UT and WY.

My guess is that they understand that the size of the magazine does not in any way change the function of the weapon, that a ten round mag and a 37 round mag or what ever will cause the weapon to function exactly the same; thus, I conclude this issue is not a 2A issue. As we have seen, fear short circuits reason, so if people are afraid of insane people running amok and shooting multiple people with large magazines, their reason will take a back seat to fear. I think they backed out because they did not want to risk so much money on lawyers in a effort to fight the ban. Just a thought.
