Whatever the Republican secretary of state of NH decides will end up state and/or federal court. Other states might have similar laws. SCOTUS doesn't issue "advisory opinions" like high courts in other countries, they want a case with facts to make their decision.

Section 3 of the 14th Amendment.
“No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may, by a vote of two-thirds of each House, remove such disability.”

It doesn't specifically say president or vice president, it states "electors" which Trump supporters would say doesn't apply to him. It does say "any office, civil or military, under the United States..." and SCOTUS would have to resolve it and as we saw in Bruen, historical context counts. It could be moot if Trump isn't convicted and hasn't exhausted all his appeals. It don't see it getting through multiple courts by Nov 5, 2024 but anything could happen.

Donald Trump actually once considered sending his political enemies to Guantanamo Bay, but didn't in part because it would be too expensive, according to a former Trump administration official.

Ex-DHS official Miles Taylor, known for secretly voicing his Trump criticisms while employed within the administration, appeared on MSNBC's Alex Witt Reports on Saturday and was discussing Trump's purported tendency to weaponize the justice system against his "adversaries."

"A number of folks who worked in the Trump Administration with me and have since spoken out against the ex president, we joke darkly about the fact that in the second term, a number of us will be in orange jumpsuits in Guantanamo Bay," Taylor said, adding that the joke isn't entirely outside of the realm of reality.

POLL: Should Trump be allowed to run for office?

"I say that the comment is half facetious, because Donald Trump actually did have a vision, while I was in the administration, to go use the terrorist prison at Guantanamo Bay to house political prisoners," he said. "In that case what he wanted to do is use it to move people from the southern border to send a message and put them in the same place where people like Khalid Sheikh Mohammed, the mastermind behind the 9/11 attacks, sits behind bars, and send a message."

He noted that "the only reason Donald Trump didn't start sending people to Gitmo" is because "he was convinced it would be too expensive, and the facility couldn't house the number of people he wanted to send there. That was the mindset of the man when he was president of the United States.

Trump could face copyright lawsuit for exploiting his mugshot

Donald Trump has raised a fortune by putting his mugshot taken at the Fulton County jail on merchandise hawked by his campaign – but it could come back to cost him.

Legal experts are warning sticking the image on T-shirts and other items could have opened his campaign up to copyright infringement complaints since law enforcement agencies hold the rights to images they circulate, Spectrum News reported.

Case Western Reserve University’s School of Law professor Betsy Rosenblatt says the photo has limits on how it's shared.

“You’re prohibited from using it for a number of things without authorization,” she said.

“You’re prohibited from reproducing it, making a derivative work of it, distributing it without authorization, or that is to say distributing anything that isn’t the one copy you already lawfully have, and various other things. Making a public display of it, making a public performance of it, which opens up all kinds of fascinating possibilities here.

Whether or not the Trump campaign will be sued for the use of the image is up to the Fulton County Sheriff's Office, but Rosenblatt says that's unlikely since it is “not going to undertake the expense and trouble of hiring copyright counsel and sending out takedowns and cease and desist letters, or in lawsuits."

The New York Attorney General's Office has asked a judge to sanction former President Donald Trump and others for repeatedly using failed legal arguments.

New York Attorney General Letitia James' office proposed that defendants in the financial fraud case against the Trump Organization be fined $10,000 collectively. The judge was also asked to impose a $10,000 fine on defense attorneys.

"The Court rejected these arguments for a second time, noting that they 'were borderline frivolous even the first time defendants made them,' and observed that reading Defendants' brief 'was, to quote the baseball sage Lawrence Peter ('Yogi') Berra, 'Deja vu all over again,'" a court filing from James' office said.

According to James, New York Supreme Court Judge Arthur Engoron can "impose financial sanctions upon any party or attorney in a civil action or proceeding who engages in frivolous conduct."

Exactly why I voted Libertarian in 2016, lesser of three evils and those pot smoking Libertarians had the best chance of a third party to win an election in history.
Also no one ever dreamed Trump would go off the deep end like he did until 2020 after we had a taste of his insurrectionist attitudes.
Thank God people realized that and voted him out.

Chatty Donnie Doll is actually mildly entertaining to see just what lines he draws between disparate peoples and his own interpretations of events. Like now apparently Nancy Pelosi is at fault for criminal negligence failing to secure the Capitol the day he instigated a riot there in a failed coupe. And Jack Smith is the one who conveniently destroyed any evidence of this as a coverup conspiracy for his pal Nancy. And now you know the real truth that no one else does so don’t you feel special?!?

His blame game really is supported by a odd sort of genius wholly designed to attack and shame others (even as he himself appears a shameless narcissist). Genius, by definition, is the ability to draw dots between previously unconnected ideas. Genius in service of evil certainly exists…
