The push comes as Republicans plan to hold a vote on a resolution to repeal a Bureau of Alcohol, Tobacco and Firearms rule classifying handguns with stabilizing braces as short-barreled rifles, which would require them to be licensed.

House GOP leadership agreed to put the bill on the floor this week as part of negotiations aimed at getting a group of GOP hardliners to stop blocking House votes. It's not yet clear if the pistol brace bill has the GOP votes to pass.
Biden has promised to veto the pistol brace bill even if it passes the Democratic Senate.

New 5th Circuit ruling in Mock v. Garland.

The ruling by 5th Circuit 3-judge panel
  • reversed order denying a preliminary injunction,
  • remanded for expeditious consideration to the United States District Court for the Northern District of Texas, directing the court to rule within 60 days of 8/1/2023, and
  • maintained the preliminary injunction, pending appeal, for 60 days starting on 8/1/2023.
The judge took issue with the Administrative Procedures Act violations, particularly
  • the replacement of Worksheet 4999 with the 6-factor test between the comment period and the final rule, with the latter being made expansive enough to reinterpret at least 99% of braced pistols as SBRs and
  • the ATF's claim that their rule were interpretive rather than legislative, wherein the agency absolved itself of any responsibility for having made changes that have the force of law.
Anything could happen in the district court.

Well researched opinion, reversed and remanded back to the district court, because of errors made by the court in denying a preliminary injunction.
The present case is also not the only one involving a challenge to the [ATF] Final Rule. Multiple judges within this [5th] circuit have already issued injunctions against the Final Rule, following the initial one issued here, enjoining enforcement against members of various gun rights organizations.

The US District Court judge for the District of North Dakota denied the plaintiffs' motion for a preliminary injunction.

The successful performance of armed self-defense
entails not only deterring or neutralizing life-threatening perpetrators, but also preserving innocent

fundamental ends of self-defense when they modify “lawfully bearable pistols” with a “rearward
attachment—whether as a brace or a stock.” Id. The increased control and precision to pistol fire
materially lowers the probability of potentially lethal misfire and collateral damage, as well as
being outmatched by or falling victim to dangerous assailants.
