Federal Judge Overturns California's Ban On Assault Weapons

Saint Benitez once again attempts to help us poor unwashed 2A step children here in CA, too bad it won't stick due to the Ninth Circuit etc (I don't have one preferring a SCR instead, but Ya'll with AR's better not lose your fins LOL!).

Funny how Gov Newscum and others are flipping out when with regards to gun murders and non-negligent manslaughters by so called "Assault Weapons", though the stats don't support their arguments, i.e. these 2017 gun homicides and non-negligent manslaughters stats are similar in scope for earlier and later years as well.

Handguns = 64% of gun homicides and non-negligent manslaughters.
Rifles = 4% of gun homicides and non-negligent manslaughters.
Shotguns = 2% of gun homicides and non-negligent manslaughters.
Other Or Not Stated = 30% of gun homicides and non-negligent manslaughters.

I heard a statistic yesterdy that more women are killed with guns by romantic partners than all of the mass murders combined each year..

So I went looking for more statistics. Some say "Every month, an average of 57 women are shot and killed by an intimate partner. Nearly 1 million women alive today have reported being shot or shot at by intimate partners, and 4.5 million women have reported being threatened with a gun by an intimate partner."

Another says "We examined an analysis of 2015 homicide data by the Violence Prevention Center, and found that about 2.5 females were killed, on average, by an intimate partner each day in the United States."

Thats insane in more ways than one.

I'm sure the state of California will appeal this ruling ASAP and it will go to the 9th Circuit Court. Since that is the most liberal Circuit Court in the nation, anybody's guess on to what will happen?

Unfortunately we here in CA know what will most likely happen as the state will appeal, and the Ninth will grant a stay, and then it'll sit in court for another decade or more (as only SCOTUS can do anything, and even with all the new Trumpers they don't seem to give a rat's a** either...).

Got to hand it to Judge (Saint) Benitez though, at least he cares!

The allure of the AR-15: As judge overturns assault weapons ban, the style of rifle remains at heart of gun control battle
Among the most popular of these are AR-15-style rifles, which have gained a loyal following of homeowners, hobbyists and hunters who largely reject the idea that they’re weapons of war. Intended to be the civilian, semiautomatic version of the military’s M-16, the AR-15 and similar models are light, easy to shoot with little recoil, and powerful.

On the other side are many who see AR-15-type rifles and other assault weapons as guns of choice for mass killers, with no legitimate civilian use. The same qualities that make them popular, they say, render them extraordinarily dangerous in the wrong hands.

Many of the nation’s most deadly mass shootings involved such weapons — including the massacres in Las Vegas (61 killed), the Pulse nightclub (49 killed), Newtown (28 killed) and Parkland (17 killed).

I bet all of us would love to see a standard definition of Assault weapons based on the US Military definition and be required to use this definition in all Federal, State and Local laws pertaining to Gun Control.
Assault rifle, military firearm that is chambered for ammunition of reduced size or propellant charge and that has the capacity to switch between semiautomatic and fully automatic fire.

I think it is ridiculous that states ban weapons based on looks not function. My Ruger Ranch Rile has the same function as the AR-15. It shoots the same ammo, 5.56 NATO, is semi-automatic, and has a detachable magazine. The only difference is it doesn't look like an evil black rifle. In my house, that job is held by my semi-automatic Socialist Revolution Yugo Underfolder AK-47.

A problem is that in using the political term "assault weapon" and the technical term assault rifle, you are referring to two different things. Disarmament enthusiasts never are going to cede control of a political term carrying a dubious, vague meaning that can be changed at will.

The problem with Assault Weapon is anything used to assault someone is an assault weapon. This can be anything from a beer bottle, baseball bat, golf club, etc to a Ford F-150 and just about anything you can think of has been used in an assault on someone else at one time or another. This includes certain parts of the body as in sexual assault. In a historical frame of reference a jaw bone of an Ass is an Assault Weapon and could be considered a weapon of mass destruction. Even today when TFG opens his mouth, that is an assault with a jaw bone of an ass.

The gun grabbers are just like the anti-abortionists, they create their own vocabulary as DM referred to. Remember "partial birth abortion" which is a made up medical procedure, but the media grabbed onto it. And they publish pictures of abortion procedures to scare potential patients. Ghost gun is another new one the media loves, instead of just saying a gun without a serial number.

It's all feelings and emotions, not about the facts of rifles or other guns.

I mean, to be fair, it's not just feelings and emotions. People get killed. We shouldn't let that "little detail" get lost in the argument about semantics.

So, numbers. Stop fighting about words. Stress the number of people killed by knives or handguns if you prefer. Might not help if bearing arms is central to your concept of self defense, community or individual. Emphasize the number of people killed by law enforcement or traffic accidents, or lack of access to medical care.

Separate the goal of saving lives from the goal of banning guns. Force proponents to articulate which one is their preference. Use the numbers to knock down the case that doing the one will achieve the other. Don't fight over words. When you do, you lose.
