That moved very quickly yesterday, the mayor, the interim chief and the city manager showed a united front.
Fort Worth Mayor Betsy Price said Monday the killing of Jefferson was unjustified.
And Dean's defense will probably surround the firearm found at the scene.
Police said in a statement that they found a firearm when they entered the room where Jefferson died. The video released by police shows two mostly blurred clips that appeared to be from inside the home, showing a firearm. At a Sunday news conference, a reporter asked police spokesman Lt. Brandon O'Neil if Jefferson was holding the gun when the officer shot. He declined to answer. "There was nothing nefarious or illegal about owning a firearm, and they presented in no way that that firearm was contributory to toward the use of deadly force here," Merritt told CNN affiliate KTVT.

The mere presence of a firearm in the house will not be an affirmative defense for the shooting if it could not be proven that the gun was held by the person who was shot by police AND that the muzzle was pointed at the officer. Insofar as the officer shot through a window in a dark house and did not identify himself as police (in the vest video) before firing at the resident, I really don’t see a good defense for this case.

But that’s why I don’t get paid the big bucks like OJ’s lawyers I guess.

Just heard a report on MSNBC that the nephew she was babysitting told investigators that she went to her purse got her gun and pointed it at the window. Officials are saying this is irrelevant because she had every right to protect herself and the cop never identified himself as a Police Officer.

Edit:
The nephews account of the incident is in the arrest warrant.

The officer not announcing himself as police on a simple wellness check is the dumbest thing he could do. It may turn out that he didn't because he thought it was a robbery, but that's not really an excuse now is it.

The police dispatch gave the call not as a welfare check but as a suspicious open door dwelling call. I bet his lawyers are going to be ll over it. But when he looked in the window he yelled show your hands and immediately fire his gun. Not identifying himself as police and not waiting for results of his command before firing.

Dean was on the force a little over a year, don't know if he was still on probation.
According to the affidavit, Jefferson’s nephew told a forensic interviewer that he and his aunt were playing video games in a back bedroom when Jefferson “heard noises coming from outside” and “took her handgun from her purse.” The boy told the interviewer that Jefferson “raised her handgun, pointed it toward the window” and “was shot and fell to the ground,” according to the affidavit. She was pronounced dead at the scene.

Don't know if police were just in uniform or full SWAT - time of day, did the sun blind Jefferson so she couldn't see who was outside... Dean declined to be interviewed by FWPD so no contradictory statements. Richard Black in Aurora had his gun pointed to the ground and police didn't identify themselves when he was killed and the DA ruled his shooting was justified. Different states with different laws, we'll have to wait and see.

It was night, about 2:30am, so she wouldn't not have been able to see out the window.

Just for some context, the former FWPD chief recently sued the city for wrongful termination after he was canned while trying to search for another job. This on top of the Panther Island shitshow means the Mayor (Betsy Price, a bit of a mixed bag politically) is under quite a bit of pressure. This is probably why they moved so fast
