Labour has vowed to table a vote of no confidence to topple Mr Johnson as soon as a Brexit delay is in place – with Monday October 21 seen as the likely day for the Commons vote.

But a senior No10 source told The Sun: “Boris won’t resign even if he loses a no confidence vote, and it is not within the sovereign’s constitutional powers to make him.

“The Lascelles Principles make this clear. The PM will advise the Queen of that and she must follow her Prime Minister’s advice. That’s how this country works.”

It's an opinion we don't know it's legal basis. Tommy Lascelles was private secretary to Kings Edward VIII (abdicated), George VI and the early years of the present Queen. Lascelles wasn't a lawyer or a legal historian. Like BoJo lying to the Queen to prorogue Parliament which he lost at the UK Supreme Court, this will end up in the courts if he tries to invoke it.

Unless Labour, Conservative rebels and the other minor parties have resolved who will be interim PM this isn't going anywhere. Conservative rebels whose votes are needed to topple BoJo want a senior member of their party as interim PM, Labour Leader Jeremy Corbyn as opposition leader insists he must be interim PM and the minor parties are split. BoJo is still more popular than Corbyn in polls.
