The rifle was too assaulty, apparently. No word on whether Quintana had government permission--FSC, BG check--to own a firearm.

Gun arrest: Rene Quintana, 29, was arrested on suspicion of weapon charges about 7 p.m. Saturday on South Airport Way at East Market Street after his vehicle was stopped for an unspecified traffic violation and he was found allegedly in possession of an illegal assault weapon.

On 5/25/19, Officers stopped a vehicle for a traffic violation in the area of S. Airport Wy / E. Market St and the driver was found to be in possession of an illegal assault weapon. Arrested was Rene Quintana, 29, for weapons charges.

Stockton, historic but a rough city south of Sacramento. The Twitter replies to a Stockton PD tweet on the arrest are brutal.
Whoever made that arrest is an embarrassment to good cops everywhere. RESIGN!

If the owner wasn't a convicted felon illegally in possession of a firearm then you jackasses are simply oathbreakers. You have nothing to be proud of here as you wipe your asses with the bill of rights. Stockton PD replies: "Here is what made this an "assault weapon" under the definition of CA Penal Code 30515. The weapon had a fore grip, detachable magazine, pistol grip, flash suppressor and forward pistol grip as defined in the text of the code."

Looks like it was almost legal. It appears to be equipped with one of the latest devices that requires a brief break in the action (separates upper from lower by a crack) for magazine changes which results in a legal AR with one exception: Can't put a 30 round magazine in a maglocked gun or you've created an assault weapon. If the magazines was not in the gun, definitely a wobbler and most likely not a felony. The CA laws are absurdly difficult to parse and getting worse every year. But don't you feel safer?

(I could be wrong on the compliance device--I haven't looked into them, having gone featureless years ago)

I can't quite tell from the photo tbh. It looks like there's something over the mag release, but I don't see the break action part. If it had one of the new devices, yah, probably a wobbler unless those are 10/30's, in which case he can probably win. Even if they are 30's, could still win if he's got another featureless rifle. If it's not one of the new devices, he's screwed, but I hope that it's still challenged as the average gun owner was not notified and would have had to have been paying attention that something they bought (perhaps years ago) all of a sudden made them a felon.
