Screwed up circumcisions are common enough that there are slang terms for it: a carelessly done one that leaves flaps of skin is known as a "frilly dilly" in archaic gay slang.

Second Detroit area physician arrested along with his wife and office staff. Apparently both physicians belong to a Shia sect Dawoodi Bohra that practices FGM.

Good. I'm glad their lawyers went for the obvious. This could get very interesting. Because FGM is already illegal in the US we can see this as a test case for all "religious freedoms" defense for all manners of dastardly deeds including the defunding planned parenthood/contraception programs and attacking abortion in the future.
And the future looks bright. They won't let these Muslim doctors get away with committing such atrocities. And in the process, the courts will likely define the limits of "religious freedoms" to not infringe on matters previously decided by law.
And such a rational decision can be the basis for quashing that defense for use by Christian Fundamentalists to wreak havoc on matters of health, rights, and other social issues here in the States.

Federal Ban on Female Genital Mutilation Ruled Unconstitutional by Judge
On Tuesday, Judge Bernard Friedman of the United States District Court for the Eastern District of Michigan ruled that Congress did not have the authority to pass the law against female genital mutilation and he dismissed key charges filed against the doctors and removed four of the eight defendants from the case.
“As laudable as the prohibition of a particular type of abuse of girls may be,” he wrote, prosecutors failed to show that the federal government had the authority to bring the charges, and he noted that regulating practices like this is essentially a state responsibility. He rejected arguments that the law allowed for such a federal prosecution because Congress has a right to regulate commerce or health care or can enact laws to support international treaties that the United States has signed.
“Federalism concerns deprive Congress of the power to enact this statute,” Judge Friedman wrote. He added in the 28-page ruling, “Congress overstepped its bounds by legislating to prohibit FGM” because “FGM is a ‘local criminal activity’ which, in keeping with longstanding tradition and our federal system of government, is for the states to regulate, not Congress.”

Thanks for the update DM, I hope the feds appeal. Friedman is a Reagan appointee, in 2014 he overturned the MI ban on same-sex marriage. The commerce clause is often used to justify federal actions in what would normally be state jurisdiction. If the feds lose at the federal circuit court then it's down to state laws on child abuse, the medical personnel involved have probably lost their state licenses to practice.

There is a big difference between male circumcision and FGM. Male circumcision reduces the risk of HIV, Genital Herpes, and HPV infections. Given rising rates of STIs in the US, I view it negligent not to circumcise. FGM has no known benefits to the patient and considerable risk.
