Kagan and Scalia - gun nuts

KNOXVILLE, Tenn. -- Supreme Court Justices Elena Kagan and Antonin Scalia are ideological opposites, yet they share a pastime. They like to hunt together.

Kagan amused an audience Friday at the University of Tennessee College of Law in Knoxville with stories of how the conservative Scalia taught her to shoot fowl.

She said Scalia told her in the spring, "It's time to move on to the big game."

She's a professional and I see no reason to see her as a threat to gun owners, regardless of the bullshit the NRA piles on the subject. Her job is to apply scholarly and legal expertise to constitutional questions and exercise judicial restraint. Personal biases and emotional factors shouldn't interfere. There's nothing in her past or her record to suggest that she will be anything but excellent at her job.

She's gone on record before:
“There is no question, after Heller, that the Second Amendment guarantees individuals the right to keep and bear arms and that this right, like others in the Constitution, provides strong although not unlimited protection against governmental regulation,”
Naturally, the NRA opposed her confirmation:
"Everything in her background suggests a vote for Elena Kagan is a vote against gun rights,"
Another reason the NRA can bite me.

Problem is, she voted no in both Heller and McDonald, plus she's a Clinton operative, so no, we cannot trust her to rule objectively, unfortunately. I wish we could. But she will vote against the 2A, no matter how much personal enjoyment she gets out of hunting. Remember that Bill Clinton used to go hunting, too--owned a semi-auto deer rifle--yet still gleefully signed the AWB into law. Dianne Feinstein, a permit-holder in San Francisco for decades and who carried for just as long--wrote and pushed the AWB, and who "will pick the time and place, no question about it" for reintroducing it. This, from a known gun owner and permit holder.

Sorry, we cannot trust Justice Kagan to vote pro-2A on the Court. Like I said, I wish we could...but we can't. I would love to see her change my view through her future votes on the Court.

Heller was voted on two years before she was appointed. Her only "crime" against 2A in McDonald was not to file friend-of-the-court brief as Solicitor General. This isn't unusual and is hardly indisputable evidence of her animosity toward 2A.

I wouldn't "trust" Kagan to vote pro-2A either, but I have no reason to believe she would vote strictly along ideological lines.
