NJ: free speech victory against HOAs

In brief, some HOAs tried to ban political signs. A case made its way through court with the NJ supreme court finally deciding 5-1 that the ban is unconstitutional.

Let me know when they say HOAs are unconstitutional... Never living in a HOA community again.

I lived in one in Roselle, IL for a few years.

They should require passports for HOA's

My friend in COLO Springs was required to keep a green lawn. If she didn't she was fined.

If she watered to keep the grass green she was fined by Colorado Springs because there was a drought and people were not supposed to be watering their lawns.

Of course... mention HOAs and it turns into an "I hate HOAs" thread.

Not that I'm in love with HOAs but ours has stayed out of our business and was helpful with getting the parking situation under control.

I can say my HOA is quite good. The provide amenities like hiking trails, a swimming pool and basketball courts, playgrounds, a community clubhouse, etc. The CC&Rs are not overly crazy, and they do keep people from perpetually fixing cars under their shade tree. Dues are just a couple hundred a year.

Other developments nearby OTOH are quite nuts. $1k+ in dues per year. No noise. No boats/toys stored outside the garage. Excessive conformity of building materials, paint schemes, etc. No construction even for DIY homeowners over the weekend. I would never choose to live in most of these places.

A friend of mine a few years ago had to replace a tree because the landscape people "trimmed it too much".
When I heard that, I decided that the 'risks' of living in a regular neighborhood were far preferable over placing your home in a fascist mini-country. It almost seems anti-American, funny that conservatives and libertarians seem to love living under the fascist rules.

My HOA forbids yard signs, so everyone puts them out. Now everyone figures out what their neighbors political affiliation is so we all know who or who not to talk to :lol:

I lived in one, a friend still lives there. It's not bad - for a few hundred per year there is a ski lift, clubhouse, park, and the best damned carpetbomb attack on snowy roads that you could not imagine. The plows roll for a half inch of snow, and they tear-ass up and down the winding curvy no-shoulder roads getting every nook and cranny amongst the development laying down a blanket of traction-encouraging cinders. The grass can get up past your knee without someone climbing up your ass, and some folks punch holes in targets from their backyards. Looks like this from above: http://img542.imageshack.us/img542/9968/friendg.jpg When someone gets a wild hair up their ass and starts looking to be a petty tyrant, there is a miniature Madison WI where people show up at meetings and make it known that the phrase "consent of the governed" is not forgotten.
