Paxton could resign, but the senate could still conduct an impeachment trial like Trump was tried after he left office. Depends on Texas law, they might need to conduct the trial to convict Paxton and make sure he can never again hold Texas public office.

Nate Paul, the Austin real estate developer central to allegations of illegal conduct by Ken Paxton, Texas’ now-suspended attorney general, was arrested by the FBI on Thursday. Paul was booked into the Travis County Jail at 4:25 p.m. on a federal warrant, said Kristen Dark, a spokesperson for the Travis County Sheriff’s Office. The nature of the charges against him have not been publicly disclosed. Paul’s attorney did not immediately respond to a request for comment. Calls to the U.S. Attorney’s Office for the Western District and Paxton were also not immediately returned.

A spokesperson for the FBI office in San Antonio declined comment, citing Justice Department guidelines. It’s not immediately clear whether his arrest is related to the allegations against Paxton, but Paul is at the center of the abuse-of-office complaints against the three-term Republican attorney general who was impeached by the Texas House last month. Paxton is currently suspended from his official duties and awaiting an impeachment trial in the Senate, which would require a two-thirds vote to permanently remove him from office.

Real estate investor central to Ken Paxton impeachment charged with 8 felonies

Nate Paul, the Austin real estate investor central to allegations of illegal conduct by suspended Attorney General Ken Paxton, has been charged with eight counts of making false statements to financial institutions.

Paul, 36, allegedly overstated his assets and understated his liabilities to fraudulently obtain loans, according to a 23-page indictment filed by federal prosecutors Friday.

The government is seeking $172 million in restitution from Paul.

U.S. Magistrate Judge Dustin Howell laid out the charges — which focus on actions Paul took in 2017 and 2018 to allegedly mislead mortgage lenders and credit unions — Friday morning to ensure Paul understood them.

Paxton was not mentioned in the indictment, nor was he discussed during a half-hour proceeding Friday in Austin's federal courthouse, where Paul appeared shackled and wearing a blue button-down shirt, jeans and white Air Jordans. He answered Howell’s questions softly, simply stating, “Yes, Your Honor.”

Paul is due back in court June 15 for arraignment. He will be released today on conditions including that he surrender his passport and leave Texas only after notifying the court. His in-state travel will be unrestricted. Assistant U.S. Attorney Alan Buie, who represented the government at the hearing and who specializes in white collar crimes, said Paul should be allowed to continue to run his businesses.

Paul’s lawyer, Gerry Morris, said outside the courtroom that the charges have nothing to do with Paxton, adding that he had “no idea” when Paul last spoke with the now-suspended attorney general.

Texas state Sen. Angela Paxton, the wife of Attorney General Ken Paxton, is barred from voting in the impeachment trial that could lead to her husband’s permanent removal from office, the Republican-controlled Senate decided Wednesday night. The rule settles a question that has loomed over the Texas Capitol since Ken Paxton last month became just the third sitting official to be impeached in Texas’ nearly 200-year history. Senators scheduled the trial to begin Sept. 5. Angela Paxton, a Republican, had not said whether she would recuse from herself helping determine whether her husband of more than 30 years will be convicted over accusations that include abuse of power and accepting bribes. That left the issue up to her fellow 30 senators, many of whom are conservative allies of Ken Paxton, who for years has maintained support among Texas Republicans despite alleged wrongdoing and scandal that has hung over him for three terms.

Under the rules, Angela Paxton is required to attend the proceedings but prohibited from participating in any way, including closed session or deliberations. The rules state that a spouse is “considered to have a conflict” under the Texas Constitution. A vote to convict Ken Paxton in the Senate would require a two-thirds threshold in the chamber, which has 19 Republicans and 12 Democrats. If all Democrats vote to convict, nine Republicans would have to join them in order to remove Paxton from office. Angela Paxton has not publicly commented on the accusations against her husband, who is also under FBI investigation and has attacked the impeachment as an attempt to disenfranchise Texas voters who elected him to a third term last year.
[Lt Gov] Patrick, who will serve as the trial’s presiding officer, carries into the proceedings financial entanglements with the accused. Ken Paxton has yet to repay a $125,000 campaign loan that Patrick gave him in 2018, when Paxton’s reelection appeared vulnerable after being indicted three years earlier on securities fraud charges. Paxton has pleaded not guilty and the case has yet go to trial. Patrick said the outstanding debt wouldn’t influence his judgement. “I have loaned money and given money to a lot of different candidates,” he has said.

The impeachment charges also allude to a senator, Republican Bryan Hughes. Paxton is accused of using him to request a legal opinion that would protect Paul from losing properties in foreclosure. Another impeachment concerns Paxton’s extramarital affair with a woman who was employed by Paul and has also worked for Republican Sen. Donna Campbell. The rules do not limit their participation in the trial.

Dan Patrick on Monday issued a wide-ranging gag order ahead of the impeachment trial of suspended Attorney General Ken Paxton, saying “out-of-court statements” by both sides could jeopardize the trial in the Texas Senate. The order, which went into immediate effect, cites what Patrick called “particularly egregious” statements that “pose a serious and imminent threat” to the impartiality of Paxton’s trial, which begins Sept. 5. Violators can be found in contempt of court and punished with up to six months in a county jail and a fine of up to $500, the gag order said. The order prohibits parties — including members of the Senate and House and their staffs, witnesses and attorneys — from making statements that they “reasonably should know” will have a “substantial likelihood of materially prejudicing the trial.”

That includes, among other statements, those “concerning the expected testimony” or “character, reputation or credibility” of witnesses, parties or attorneys involved in the trial, and “any opinion” as to whether the articles of impeachment should be dismissed or sustained, the gag order said. The order also bars statements about the “identity or nature” of evidence that may be presented at the trial, statements about subpoenas issued in the matter, or statements about “any information” that could “create a substantial risk of prejudicing” the trial. I agree, this is a political process in the political arena and what would end up in the media would be carefully crafted soundbites lawyers would use to support their side. After each day of the impeachment trial each side will be in front of the cameras spinning it for their side. Both the gag order and banning Paxton's wife from being involved in the proceeding are all positives.

I really don’t know which way this flips, but there’s logic to get rid of him. It might save the republicans some embarrassment and take some kindling away from the democrats before the next election. There’s positives for the republicans in removing him.

That's my thinking. Republicans control the Texas House by 22 seats, fuck this up and they could lose more seats next year. I think Republicans want to get rid of Paxton before the feds try and convict him and Democrats take credit for getting rid of him. Some politicians have a whiff of corruption, Paxton smells like he was sleeping with pigs.

Step one should be to find his ass guilty of malfeasance of the office and remove him from office.

Pro-Paxton group gives $3 million to impeachment trial judge Dan Patrick

Lt. Gov. Dan Patrick, who is presiding over the impeachment trial of suspended Attorney General Ken Paxton, received $3 million in campaign support last month from a top group campaigning against Paxton’s impeachment.

In a campaign-finance report published Tuesday, Patrick — who is not up for reelection until 2026 — reported a $1 million contribution and a $2 million loan from Defend Texas Liberty PAC. The political action committee was by far his biggest benefactor on the report, which covered Patrick’s fundraising from June 19-30. It was the first opportunity state officials had to fundraise since the House impeached Paxton in late May.

Patrick’s Senate has scheduled a trial to begin Sept. 5 to determine whether to permanently remove Paxton from office. Patrick has been acting as presiding officer of the trial — effectively the judge — and the fundraising period partially overlapped with the Senate’s deliberations over the trial rules. The chamber approved the rules June 21.

The news of the PAC's financial support came the day after Patrick followed through on a requirement in the rules and issued a sweeping gag order on all parties involved in the trial.

The PAC's stance on Paxton's impeachment is well-known. Shortly after the House impeached Paxton, Defend Texas Liberty PAC sent text messages to GOP voters asking them to call their state senators and tell them to “stop this madness and end this witch hunt.” It has also made clear it will politically target House Republicans who voted for impeachment.

“Defend Texas Liberty will ensure that every Republican voter in Texas knows just what a sham the Texas House has been this session and just how absurd this last minute Democrat led impeachment effort is,” the group said in a May 26 tweet.
