Several classified documents from President Joe Biden’s time as vice president were discovered last fall in a private office, Biden’s attorneys acknowledged Monday. Attorney General Merrick Garland has asked the US attorney in Chicago to investigate the matter, a source familiar with the matter tells CNN, and congressional Republicans are also taking notice. Biden’s lawyers say they found the government materials in November while closing out a Washington, DC-based office – the Penn Biden Center for Diplomacy and Global Engagement – that Biden used as part of his relationship with the University of Pennsylvania, where he was an honorary professor from 2017 to 2019. Fewer than a dozen classified documents were found at Biden’s office, another source told CNN. It is unclear what the documents pertain to or why they were taken to Biden’s private office. Federal officeholders are required by law to relinquish official documents and classified records when their government service ends.
After the discovery, Biden’s lawyers immediately contacted the National Archives and Records Administration, which started looking into the matter, the source said. Biden’s team cooperated with NARA, which later came to view the situation as a mistake due to lack of safeguards for documents, the source said.

In November, NARA sent a referral to the Justice Department to look into the matter, a source with knowledge of the situation told CNN. The US attorney in Chicago, John Lausch Jr., is investigating. Lausch was one of the rare Trump-era holdovers who wasn’t asked to resign after Biden’s inauguration. He was appointed by Trump in 2017 and unanimously confirmed by the Senate. Illinois’ two Democratic senators said in 2021 that they wanted Lausch to remain at his top post “to conclude sensitive investigations,” though they didn’t reveal what probes he was working on.

Republicans are already asking questions. President Biden has been very critical of President Trump mistakenly taking classified documents to the residence or wherever and now it seems he may have done the same,” said GOP Rep. James Comer of Kentucky, who is set to become the House Oversight Chairman. “How ironic.” Comer pointed out that the National Archives falls under his committee’s jurisdiction for oversight but said when they, while in the minority, sent NARA questions related to former Trump, NARA referred Republicans to the Justice Department.

National security lawyer Bradley Moss took to Twitter to note that the story is drawing a stark contrast with Trump.

In particular, he cited a statement from Richard Sauber, special counsel to the president, who said that "that on the same day the material was discovered, Nov. 2, the White House counsel's office notified the National Archives, which took possession of the materials the following morning.”

"This right here is the difference. They immediately cooperated," Moss explained.

In fact, the CNN story reveals that the documents have been locked up for five years, there was no request for them from he National Archives, and no flaunting of the documents by Biden. Trump's documents were stored in a pool storage room and there is evidence that he defied multiple requests to return them.

In fact, it's entirely possible Biden didn't even know he had them. The FBI wasn't called in to negotiate with anyone on Biden's team for the documents. There was also no search warrant issued for the FBI to search the locked offices for the documents.

As Moss pointed out, the day the documents were discovered the Biden team reached out to the National Archives and it was sent to the Justice Department without incident.

Unlike TOS, Biden's team found it, reported it, and is FULLY COOPERATING. There is NO similarity to what TOS did.

And that's the way politics works. The party that doesn't control the WH hammers and hammers and hammers away at the 'incompetence' and 'criminality' of the party in power. It's just what Democrats did when Trump was in the WH and when W and Obama were in the WH. Partisans on both sides will be pushing this one until the 2024 election and then maybe it will die.

President Biden’s aides found a new batch of classified documents at a second location associated with Mr. Biden, according to a person familiar with the situation — the second disclosure in three days of his retention of government files dating from his vice presidency. It is not clear where or when the documents were recovered. But Mr. Biden’s aides have been scouring various places since November, when his lawyers discovered a handful of classified documents, which included briefing materials on foreign countries, when they were closing a think tank office in Washington.

The discovery of the second batch was earlier reported by NBC News on Wednesday. A White House spokesman and a member of Mr. Biden’s legal team did not immediately return requests for comment. A spokesman for the Justice Department declined to comment. The new revelation is sure to intensify Republican attacks on Mr. Biden, who has called former President Donald J. Trump irresponsible for hoarding sensitive documents at his private club and residence in Florida. This week, the new Republican chairman of the House oversight committee issued a far-ranging request to the National Archives and Records Administration, which is supposed to receive all highly sensitive materials after an administration leaves office, for documents and correspondence.

The House investigation of the classified documents at the Penn Biden Center will no doubt also include an investigation of the funding for the Center.
The University of Pennsylvania received more than $30 million from Chinese donors shortly after the Penn Biden Center for Diplomacy and Global Engagement, which functioned as an office for Joe Biden before he was elected president, was announced in 2017, according to public records. “The Penn Biden Center is a dark money, revolving door nightmare where foreign competitors like China donated millions of dollars to the university so that they could have access to future high ranking officials,” said Tom Anderson, director of the Government Integrity Project at the Virginia-based National Legal and Policy Center.

The University of Pennsylvania raked in a total of $54.6 million from 2014 through June 2019 in donations from China, including $23.1 million in anonymous gifts starting in 2016, according to public records. Most of the anonymous donations came after the university officially announced in February 2017 that it would create the academic center named for Biden, whose term as vice president under Barack Obama had just ended. In addition to leading the think tank, Biden was also named a professor at the school.
Meanwhile, former fellows and administrators of the Penn Biden Center now have key positions in the Biden administration. Michael Carpenter, the former managing director of the Penn Biden Center, was named the US ambassador to the Organization for Security and Cooperation in Europe, based in Vienna, in 2021. Secretary of State Anthony Blinken also briefly served as director of the think tank before joining the Biden administration in January 2021. Before that, Blinken was a policy advisor for President Biden’s 2020 campaign. Juan Sebastian Gonzalez, a senior fellow at the center from April 2018 to September 2020, is currently special assistant to the president and the National Security Director for the Western Hemisphere at the White House, according to his LinkedIn page.

The second set of classified documents from President Biden’s time as vice president were discovered at a storage space in the garage of his home in Wilmington, Del., a top White House lawyer said on Thursday. The Times reported on Wednesday that this second set of documents had been found at a location “associated” with Mr. Biden. On Thursday the White House statement offered more detail by specifying that the location was his private residence, where he often spends weekends.

The White House statement, by Richard Sauber, a special counsel to Mr. Biden, did not answer fundamental questions about the contents of the documents, who packed them and whether anyone had gained access to them after he left office. It also did not say when the second batch had been found. The statement came after the White House acknowledged this week that an earlier batch had been discovered on Nov. 2 in the closet of an office at a think tank that Mr. Biden had used after leaving the vice presidency.

The statement added that the Biden team immediately notified the Justice Department and arranged for it to take possession of the documents. Mr. Sauber said Mr. Biden’s team had also searched a house the president owned in Rehoboth Beach, Del., but found no documents stored there.

This is a nothing burger in comparison to turds cache of docs. But, if I'm wrong, prosecute Biden when he's a citizen again. Plus get the Hunter Biden case going and indict Hunter - if it's a nothing burger or not, so be it.

Merrick Garland assigned John Lausch, Jr the US Atty for the Northern District of Illinois (Chicago) to investigate Biden's case. Lausch is a hold over originally appointed by Trump in 2017, both US senators from IL supported retaining him and Biden kept him.

A former Democratic US Atty I heard recommended that Garland appoint a special counsel to investigate Biden, just like he did with Trump's case. Even though the facts of each case aren't exactly the same, distance both cases from the political arena.

Whether the documents were kept in a mayonnaise jar (Hell Man, give 'em a break!) on F&W's doorstep, or in the glove box of a (got caught)little red corvette(handed), they were clearly secure and posed no danger to national security.

What gets me is if I have an overdue library book, (The Story of Victoria's "Secret's") they track me down to get it back. If it's national security related secret documents, no one even seems to know that they've been checked out half the time. Makes one wonder what else is out there. Better check my garage, just in case.

As has been pointed out these documents are stamp Classified not Top Secret or Top Secret, Need To Know where you go into the little guarded vault to read it.

When my Dad was recalled back to work on the F-16 at Lockheed he was given a notebook to read so he could become familiar with the Avionics / Electronic systems of the F-16. It was marked Classified.He was told to take it home and read it. So he did. When he finished he ask where does he go to return it. They told him to keep it or toss it. He pointed out that it was marked Classified and the supervisor said, "Don't worry, the Russians and Chinese already have stolen copies."

This just had my Dad shaking his head. Through most of his Military Career he had a Top Secret or better clearance, "Need to Know" . The need to know is a clearance higher than Top Secret. It is bestowed on those that are working on projects that are so sensitive that a top secret clearance isn't enough. When he retired from the Air Force with his retirement briefing he was told that for the next ten years if he was to leave the US soil he had to get clearance and approval from both the DOD and State Dept.

I guess with later years we have become sloppy with our security.

Five more pages containing classified information were found at President Biden’s Delaware home on Thursday, the White House said on Saturday, bringing the tally to six such pages uncovered this week. The additional pages, a person with direct knowledge of the matter said, were discovered hours after a White House statement on Thursday morning that cited only one that Mr. Biden’s aides had discovered the night before in a storage area adjacent to the garage of the president’s home in Wilmington. Thursday evening, the White House said, Justice Department officials had gone to retrieve that page, and a White House lawyer had met them to oversee the transfer. Five additional classified pages were then identified among the materials with it.

The revelation came as Mr. Biden’s lawyers provided new details about their unfolding discovery over the past two months of classified materials from his time as vice president at his house and an office he used before beginning his 2020 campaign for the White House. Attorney General Merrick B. Garland appointed a special counsel on Thursday to investigate Mr. Biden’s handling of sensitive records. They also defended their decision not to be fully forthcoming about the matter. The White House has been criticized over its public disclosures, including why it did not reveal the discoveries much earlier, and why, when it acknowledged on Monday that some classified files had been found at Mr. Biden’s office on Nov. 2, it did not indicate that more had been found at his house the next month. Mr. Biden’s lead personal lawyer, Bob Bauer, said in a statement on Saturday that the president’s legal team had tried to balance being transparent with “the established norms and limitations necessary to protect the investigation’s integrity.”
After Mr. Biden’s personal lawyers discovered Obama-era documents on Nov. 2 in a closet of an office Mr. Biden had used at the Penn Biden Center think tank in Washington, the White House notified the National Archives and Records Administration of their discovery. For the next eight days, Mr. Biden’s personal lawyers worked with the archives until Nov. 10, when the Justice Department informed them that it had begun a preliminary inquiry into what happened. “Once the president’s personal attorneys heard from D.O.J., the president’s personal attorneys were in regular contact with D.O.J.,” Mr. Bauer said.

The National Archives’ inspector general told the Justice Department about the matter on Nov. 4, and the department opened an inquiry on Nov. 9. Some critics have said the Biden team should have notified the Justice Department even earlier. On Dec. 20, as has been known, Mr. Biden’s personal lawyers inspected the garage of the president’s Wilmington house and found what Mr. Bauer called “a small number of potential records bearing classified markings.” According to Mr. Bauer, they stopped their search and alerted the Justice Department, which took the records from the garage the next day. Mr. Biden’s personal lawyers were searching Mr. Biden’s houses in Wilmington and Rehoboth Beach, Del., on Jan. 11 for any additional records when they found the one-page file in the storage space in Wilmington.

Republicans are already preparing to investigate this and no doubt there will be public hearings, it probably won't get the media coverage that the J6 Committee got. The first documents were discovered Nov 2nd at the Penn Biden Center and the WH conveniently waited until the midterm election (Nov 8th) was over before revealing it.

Our clearance and classification system is broken, has been for years, and that's the least secret thing about it. I bet that raids on Obama's library, the Bush ranch in Texas, and Bill Clinton's porn stash would all have similar results. I mean, we already know about Hillary's servers. I hope George Herbert Walker Bush had better document hygiene, but he had been CIA chief back in the day.

In normal times this would lead us to bipartisan legislation to further regulate the handling and disposition of classified information in the executive branch - rather than fixing a system that classifies and need-to-knows shit that's already OSINT if not public knowledge. Gentlemen's agreement that everyone fucked up and that they'll make life miserable for the aides who have to handle the paperwork for the foreseeable future rather than prosecute anyone on either side. Damn, I miss normal times.

Plenty of other reasons to send Donny to prison for the rest of his miserable life - but I appreciate that every day he lives free, he lives in fear of the next shoe.
