On Monday, justices heard arguments for the case, which concerns the authority of the EPA to govern power plants under a Barack Obama-era climate regulation known as the Clean Power Plan. The plan was never put in place — it was repealed by the Trump administration before it could go into effect and hasn’t been reinstated by Joe Biden — meaning that the High Court is ruling on a challenge to regulation that effectively doesn’t exist.

The Supreme Court is “looking to set a precedent for the future, essentially going outside of its jurisdiction to prevent future EPA rulemaking on power plant pollution,” Data for Progress wrote in its post about the polling. “This is a dangerous case that could gut some of the most impactful provisions of the Clean Air Act and permanently hamper the EPA’s ability to reduce greenhouse gas emissions from the power sector.”

The plaintiffs are arguing that the Supreme Court should apply a doctrine favored by right-wing extremist Justice Brett Kavanaugh, known as the major questions doctrine, which limits agencies’ ability to regulate in areas of economic and political importance — essentially limiting the scope of the government overall.

Some of remember when there were smog warnings and being told to stay indoors.

Some of us remember when the rivers were so polluted they caught fire.

Some of us remember whole towns being abandoned because of an underground coal fire.

All of the Justices are old enough to know that as well.
To be vintage it must be older than me!

Issue: Whether, in 42 U.S.C. § 7411(d), an ancillary provision of the Clean Air Act, Congress constitutionally authorized the Environmental Protection Agency to issue significant rules — including those capable of reshaping the nation’s electricity grids and unilaterally decarbonizing virtually any sector of the economy — without any limits on what the agency can require so long as it considers cost, non-air impacts and energy requirements.
Truthout has a slant, the article is about a survey not the elements of the case. The case was argued in February 2022 so there should be a decision next week unless they want it reargued next term.

It all comes back to campaign finance. As long as huge corporations buy Congressional seats, those who occupy those seats work for THEM - NOT their constituents.
I don't see a way out of this. Congress is not about to vote to blow up their gravy train, and financiers are not going to stop buying them. No other investment comes close to the return of this one.

The actual decision came down from SCOTUS on West Virginia vs EPA.
The Supreme Court ruled in favor of conservative states in West Virginia v. Environmental Protection Agency, delivering a major blow to the Biden administration's ability to regulate climate change.

In a 6-3 ruling, the Court adopted a narrow reading of the Clean Air Act. The opinion stated that Congress did not give the EPA the power to devise emissions caps based on the generation shifting approach the Agency took in the Obama-era Clean Power Plan.

Chief Justice John Roberts wrote the opinion. Justice Elena Kagan dissents, joined by Justices Stephen Breyer and Sonia Sotomayor.
