Gun dealers are not considered an essential business, and they’re not happy about it
Gov. Phil Murphy’s executive order to close all non-essential retail business has forced gun dealers, who were experiencing a spike in sales amid the anxiety surrounding the coronavirus pandemic, to shut down.

On Saturday, the online service used to process background checks for firearm dealers, the New Jersey National Instant Criminal Background Check System, told stores they can no longer process requests.

“Per Executive Order 107, (Murphy) is ordering the residents of New Jersey to stay home, directing all non-essential retail businesses closed to the public,” a notice on the online system states. “At this time, the order includes New Jersey Firearms State Licensed Dealers.”

In a telephone interview this afternoon with CNJFO, Pitera stated that he researched ways to keep his business open so that he can continue to provide for his family. This new business approach keeps business flowing and meets the ammunition needs of the Second Amendment community.

After researching the limitations of Governor Phil Murphy’s Executive Order 107, Pitera determined that deliveries and online orders are permitted, even though brick and mortar stores are to remain closed.

N.J. Gov. Murphy Hit with Federal Lawsuit by Second Amendment Foundation
SAF is joined by the New Jersey Second Amendment Society, on behalf of Robert Kashinsky and Legend Firearms, a gun shop in the state. They are represented by noted civil rights attorney David Jensen at Jensen & Associates in Beacon, N.Y. He is also representing SAF and the Connecticut Citizens Defense League in a federal lawsuit against the state of Connecticut’s prohibition on so-called “high capacity magazines.”

In the New Jersey case, Gov. Phil Murphy and State Police Supt. Patrick J. Callahan are defendants in their official capacities. The complaint, filed in U.S. District Court for the District of New Jersey, alleges depravation of rights under 42 U.S.C. § 1983. The case is known as Kashinsky v. Murphy. The lawsuit contends that Murphy, by issuing Executive Order 107 on March 21, mandated “the closure of all retail businesses that sell firearms or ammunition and of making the portal for firearms background checks unavailable on the website of the New Jersey State Police…amount to a ban on obtaining firearms or ammunition in the State of New Jersey.”

“A safer society for my taste has fewer guns and not more guns,” Murphy said Wednesday at his daily coronavirus press briefing. “The guns that do exist are at the hands of the right people, particularly trained members of law enforcement.
There are 2 lawsuits in New Jersey, Kashinsky v Murphy and ANJRPC v Murphy.

Following a lawsuit against the state of New Jersey by the Second Amendment Foundation and a declaration by Homeland Security that gun makers, retailers and ranges are critical infrastructure, New Jersey Governor Phil Murphy has done an about face and announced that firearm retailers in the Garden State will be allowed to reopen.

Gun retailers in New Jersey can now open as an essential business during the coronavirus outbreak, Gov. Phil Murphy announced Monday in a reversal of his previous position on this issue.

Murphy’s decision to deem firearm dealers an essential business follows guidelines issued by the federal Department of Homeland Security, which added gun dealers, ranges and manufacturers to its essential business guide for its coronavirus response on Saturday.

A recent contact made with the New Jersey State Police hotline revealed a telling picture of the level of firearm demand we are currently experiencing. As we have reported previously, multiple attempts to contact the State Police firearms hotline were met with endless ringing, repeated voicemails, and instructions from operators that there is nothing they can do to help. Now we are starting to understand why.

In the video below, we get an indicative picture of the unprecedented firearm demand. Never forget; if you’re looking for an abortion or for increased welfare benefits, our state-funded social service and healthcare hotlines are fully-staffed and ready to refer you to “essential” service centers for those selective needs. However, when it comes to lawful firearm acquisition, every excuse imaginable is thrown at our callers, along with an enormous dose of indignation and sarcasm. This of course, is IF you are lucky enough to have a human pick up the phone.

When we legally permit the state to “approve” our rights, we are doing nothing more than giving them the opportunity to deny us at their total whim. The Covid-19 quarantine has pulled back the veil in an unprecedented fashion; new and old firearm owners alike are now realizing they are nothing more than slaves in the eyes of the state. How ironic it is – that those holding the exclusive monopoly of violent force are also the ones tasked with approving our sacred “right” to defense. During these times, it is important to remember that multiple court cases have upheld that no individual has a right to protection from police or other government entities. Keep that in mind as you hear the endless dial tones to your state barracks – and remember that even after this quarantine subsides, the next “emergency” is only an “executive order” away…

Given the fact that Gov. Murphy is doing a VALIANT job trying to protect us in NJ from this plague that has hit OUR state harder than any but New York, and harder than all but 7 nations, and has ACTUALLY kept our death rate below the national average, I'm willing to forego any criticism of his stance on guns and gun-related issues until this is over.

I'm MUCH happier with him than with idiot governors like DeSantis, Kemp, and Abbott, who may be "good" on guns but who are happy to let tens of thousands get sick and die because they want to be "liked" by the stupid sadistic prick in the White House.
