SCOTUS rejects appeal in Wisconsin case against Armslist

Court won’t revive suit against gun site over spa shooting
WASHINGTON (AP) — The Supreme Court won’t revive a lawsuit against a firearms website over a suburban Milwaukee spa shooting.

The justices rejected an appeal Monday from the daughter of one of three people shot to death by a man who illegally bought a semi-automatic pistol and ammunition from someone he met through Armslist.com.

The Wisconsin Supreme Court dismissed the suit, ruling that federal law protects website operators from liability for posting content from a third party. The state court rejected arguments that websites that enable gun deals must take reasonable care to prevent sales to people prohibited from purchasing firearms. The Wisconsin shooter was under a court order that prohibited him from possessing guns.

The daughter of a mass shooting victim lost her bid to argue before the U.S. Supreme Court that Armslist LLC should be held liable for selling the killer a gun online.

The justices Nov. 25 denied a petition by Yasmeen Daniel to review a Wisconsin Supreme Court decision that a federal online publisher law prohibited her from suing the firearms website.

The high court turned down the chance to review the scope of Section 230 of the Communications Decency Act, which grants websites broad immunity from liability for user-posted content. Several bills are pending in Congress to change the decades-old law as part of a wide-ranging look into how big tech companies police content on their platforms.

It seems to me that whether the plaintiffs prevail or suffer defeat, they won. Their goal is to cripple the industry via the exorbitant cost of mounting a legal defense. Prevailing in the actual lawsuit would just be icing.

Like almost every other industry, the oligarchs will survive and thrive. The upstarts will be purchased or squashed.

Glancing through the PDF it seems this is their case:
16. Jones, in 2017, purchased a Glock 26 9mm handgun (“the Handgun”) from
Caldwell through his Armslist.com “store.” Jones foreseeably resold the Handgun into the broader
criminal market, where it ultimately was obtained by Shomari Legghette, a Prohibited Purchaser
unable to buy guns in the legal firearms market due to past felony convictions. Legghette
foreseeably used the Handgun to murder Commander Bauer on February 13, 2018.
And Armslist is a place for legal commerce that we don't like.

Various municipalities already are trying to get rid of firearm dealers.

In Wisconsin you can have a gun store in a bar. I dunno how common that is, but I've been in one.

Can't do that in Texas any more. One of our local liquor stores is called Guns and Liquor but the truth of the matter is that the owner died, the family stopped the gun business, and the state changed the laws. So now they just sell the T-shirts.

Jones foreseeably resold
Legghette foreseeably used
Yeah those are leading statements that require hard proof. Fault lies with the straw purchaser, Jones, who won't be buying guns for anyone now. Unless they plan on banning online liquor sales and pharmacies as well, i don't see an online gun store going poof unless they somehow they get shut down by spurious lawsuits against public participation.

Oh that would be a fun way for anti-gunners to go out, get struck down for anti-SLAPP law violations.
