Trump-loving Rep. Louie Gohmert (R-TX) on Monday filed a lawsuit against Vice President Mike Pence in the latest desperate bid to overturn the results of the 2020 presidential election.

Gohmert's lawsuit against Pence asks a Trump-appointed judge to rule that the vice president is authorized to throw out the already-cast electoral college votes and instead appoint his own slate of pro-Trump electors to give the president a second term.

Legal experts are broadly dismissingly the lawsuit, with Georgia State University School of Law professor Anthony Michael Kreis dubbing it "insane."

Gerrymandering.

Like Texas Republicans, the only possible outcome of gerrymandering is something like Marjorie Taylor Green and the rest of the Republicans. They only need to worry about a GOP primary opponent, so they run far-right campaigns. Unfortunately, the far-right wins and controls the congressional delegations regardless of the statewide popular vote.

I liked the candidate who ran against Gohmert this year. It took guts for someone to run in that R+25 district.

We have a few districts like that here (Marjorie Taylor Greene's district). GOP voters in those districts would elect a dead jellyfish over Mother Teresa (if Mother Teresa ran as a Democrat).

A federal judge on Friday dismissed a GOP-led lawsuit aimed at empowering Vice President Mike Pence to unilaterally overturn President-elect Joe Biden’s victory, contending that the plaintiffs — Rep. Louie Gohmert (R-Texas) and 11 Arizona Republicans who would have been electors for Donald Trump — lacked standing to sue.

U.S. District Court Judge Jeremy Kernodle, a Trump appointee based in Tyler, Texas, said the suit, which was filed against Pence, couldn’t be brought by an individual member of Congress, since it alleged an injury that would apply to the entire House and Senate.

Gohmert had asked the court to declare that Pence, who is constitutionally required to preside over the Jan. 6 session of Congress to certify the results of the 2020 election, had the sole authority to decide whether some of Biden’s electoral votes should be rejected — and whether alternative slates of Trump votes could be introduced instead. But Kernodle said Gohmert’s argument relied on entirely speculative circumstances.

“Congressman Gohmert’s alleged injury requires a series of hypothetical—but by no means certain—events,” the judge wrote in his 13-page ruling issued Friday evening. “Plaintiffs presuppose what the Vice President will do on January 6, which electoral votes the Vice President will count or reject from contested states, whether a Representative and a Senator will object under Section 15 of the Electoral Count Act, how each member of the House and Senate will vote on any such objections, and how each state delegation in the House would potentially vote under the Twelfth Amendment absent a majority electoral vote.” “All that makes Congressman Gohmert’s alleged injury far too uncertain to support standing under” the Constitution, Kernodle added.

Kernodle’s decision did not completely slam the door on the possibility that Gohmert or the would-be electors might be able to get some relief in court. The judge dismissed the case without prejudice, meaning that Gohmert’s lawyers could try to reframe the suit so it will pass legal muster. Gohmert, who filed the suit on Sunday, had asked for a final ruling from Kernodle by Jan. 4 in order to have time for potential appeals.

Late Friday, Gohmert and the Arizona plaintiffs notified Kernodle they were appealing to the Fifth Circuit Court of Appeals, and Gohmert told Newsmax he expected the court would act ahead of Jan. 6.

Gods help us with the Fifth Circuit Court of Appeals, it is the most right wing conservative appeals court in the US. It also hasn't helped that MoscowMitch has loaded it up with tRump appointees make it even more Radical Right.

Kernodle, a Trump appointee, may have appeared diplomatic, and, while saying that Screwy Louie was suing the wrong entity, he KNOWS that it's virtually impossible for the screwball to either appeal his decision (which will be upheld) or to re-write the suit to sue Congress in before Wednesday's Election Certification process.

I think it was a very clever decision, leaving an "opening" that isn't any opening at all.

This accomplishes two goals for the GOP:

1. They have convinced their voters that illegal voting is a huge problem (it isn't) and will crack down by reducing polling places in blue cities and curtailing voting by mail. Voter suppression, big lies, and gerrymandering work well for the GOP.

2. The GOP will insist that liberal activist judges are the real problem in courts (they have been saying this for decades). They will continue the drive toward authoritarian judges and courts. It works in Russia, China, and other mafia states.

the theory here as practiced by donald and "friends" has always been to sue the little guy, someone without a lawyer on retainer. that way you can exhaust their finances and win by default without actually having a legal leg to stand on. what they seem to have forgotten is that states, federal govt and other congressmen often can afford lawyers of their own, good ones even, and sometimes more money to throw at the case than they do. losers, lazy bullies, eyes too big for their stomachs.

Next time, in a close election, it can work. Remember that Biden/Harris barely won the electoral college by raw votes.

My tin foil hat self believes that they cheated in other states like Florida, North Carolina, and Texas and assumed they would win. Imagine their surprise when they lost Arizona and Georgia. Why else would they be screaming about this so much? They always accuse the other side of what they are actually doing.

Appeals court shoots down GOP lawsuit — before the defendant could even file a legal brief

Republicans seeking to overturn the results of the 2020 presidential election continued to face legal setbacks on Monday -- nearly two months after President-elect Joe Biden was declared the winner.

"A federal court swatted down the latest bid by the head of the Arizona Republican Party to change the rules for counting electoral votes," the Arizona Daily Star reported Monday.

"After Kelli Ward and her fellow plaintiffs filed their paperwork, it took just eight hours and three minutes for the Fifth Circuit Court of Appeals to rule they have no legal standing to challenge the Electoral Count Act. The plaintiffs' list also includes Republican U.S. Rep. Louie Gohmert of Texas. In fact, the three-judge panel didn't even wait for Vice President Mike Pence, who is the defendant in the lawsuit, to file a reply to the plaintiffs' legal brief," the newspaper noted. "Instead, the judges said all they needed to do is review what was filed in trial court as well as the 13-page opinion of U.S. District Court Judge Jeremy Kernodle, who tossed the case only a day before on the question of the right to sue."

All three of the judges were appointed by Republican presidents -- one was even appointed by President Trump.

"Absent intervention now by the U.S. Supreme Court, that clears the way for Congress to meet on Wednesday to count the electoral votes which, according to results certified by the states, would make Democrat Joe Biden the next president, with 306 electoral votes —including 11 from Arizona — against 232 for the incumbent," the newspaper noted.

Rep. Louie Gohmert has had a long legal career since graduating from Baylor Law School in 1977, but is now facing legal sanctions for his attempt to overturn the result of the 2020 presidential election.

"A national lawyers group on Monday called for professional licensing bodies to investigate East Texas congressman Louie Gohmert and his attorneys for what it called a 'self-evident breach' of ethics rules for lawyers when they sued unsuccessfully last week to try to force Vice President Mike Pence to overturn the results of the Nov. 3 presidential election," The Dallas Morning News reported Monday. "Lawyers Defending American Democracy, a nonpartisan group that says it has the support of 5,000 lawyers across the country, said in a statement that Gohmert, Dallas lawyer William L. 'Lewis' Sessions and unnamed other lawyers should be sanctioned for egregious conduct."

"They and other plaintiffs and lawyers involved in the suit invoked the 12th Amendment: 'The President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted.' Lawyers Defending American Democracy said the amendment doesn't allow a vice president to pick which electoral votes to count for a given state," the newspaper reported.

U.S. District Judge Jeremy Kernodle threw out the lawsuit on Friday. Judge Kernodle was appointed by Trump. The ruling was upheld by a federal appeals court on Saturday.
