Texas Attorney General Ken Paxton fled his home to avoid being served with subpoena, court record says

Texas Attorney General Ken Paxton fled his home in a truck driven by his wife, state Sen. Angela Paxton, to avoid being served a subpoena Monday, according to an affidavit filed in federal court.

Ernesto Martin Herrera, a process server, was attempting to serve the state’s top attorney with a subpoena for a federal court hearing Tuesday in a lawsuit from nonprofits that want to help Texans pay for abortions out of state.

When Herrera arrived at Paxton’s home in McKinney on Monday morning, he told a woman who identified herself as Angela that he was trying to deliver legal documents to the attorney general. She told him that Paxton was on the phone and unable to come to the door. Herrera said he would wait.

Nearly an hour later, a black Chevrolet Tahoe pulled into the driveway, and 20 minutes after that, Ken Paxton exited the house.

“I walked up the driveway approaching Mr. Paxton and called him by his name. As soon as he saw me and heard me call his name out, he turned around and RAN back inside the house through the same door in the garage,” Herrera wrote in the sworn affidavit.

He's a real "stand up guy," right?

Wrong. He lacks the courage of his convictions, and probably deserves to be convicted of something.

A process server named Herrera? Sounds like a brown name to lily-white Paxton. He did say he feared for his life when a brown gentleman called out his name and held out a piece of paper didn’t he? Some white folks are sensitive that way, bless their heart.

Nothing like a state's Attorney General rabbiting to escape being served with a subpoena!
That alone should be sufficient to have him removed from office, or at least be dis-barred.

Guess they both figure they'll be shanked in prison. I gather that the convicts are not real forgiving of the LEOs and prosecutors who put them there, and when they get a chance at them.............

Attorney General Ken Paxton ordered to testify in abortion lawsuit after evading subpoena

A federal judge has ordered Texas Attorney General Ken Paxton to testify in an abortion rights lawsuit. U.S. District Judge Robert Pitman had previously quashed the subpoena, which Paxton fled his home to avoid being served.

In a hearing last week, lawyers representing abortion rights nonprofits asked Pitman to reconsider and require Paxton to testify. Pitman granted their motion on Tuesday.
Accordingly, lawyers for the abortion funds tried to serve Paxton with a subpoena to get him to testify in last week’s hearing. Emails show that Paxton’s office was aware that they intended to serve him with a subpoena before the process server showed up at his home on Sept. 26.
But in Tuesday’s order, he said he did so “on the assumption that counsel for Paxton had made candid representations to the Court … only to learn later that Paxton failed to disclose Plaintiffs’ repeated emails attempting to inquire as to whether Paxton could testify.”

Pitman also sided with the abortion funds’ argument that Paxton has unique, first-hand knowledge that requires him to testify.

Don't be surprised if Kenny Boy appeals the decision to the 5th Circuit Court. With his record as AG and the Federal Courts he might as well give up and testify.
