Former President Donald Trump on Monday morning posted an angry rant about the FBI searching his Mar-a-Lago resort -- and he accused FBI agents of leaving his bedroom dirty by not taking off their shoes.
"Arrived in Florida last night and had a long and detailed chance to check out the scene of yet another government “crime,” the FBI’s Raid and Break-In of my home, Mar-a-Lago," Trump wrote. "I guess they don’t think there is a Fourth Amendment anymore, and to them, there isn’t."
"In any event, after what they have done, the place will never be the same," he wrote. "It was 'ransacked,' and in far different condition than the way I left it. Many Agents - And they didn’t even take off their shoes in my bedroom. Nice!!!"

If I was the FBI agents, I wouldn't have removed my shoes for fear I would catch something from him.

They really need to follow up on what was removed from Mar-A-Loco and taken to Bedminster and maybe other TOS properties.

Can't get it through his thick totally inflexible head that the 4th Amendment provides for a procedure to produce a search warrant, and THAT procedure was followed to the letter!

Now DOJ needs search warrants for Bedminster and Trump Tower.

Team Trump refuses special master's order to list which Mar-a-Lago documents Trump 'declassified'

Attorneys for former President Donald Trump on Monday responded to their special master's Saturday request to identify which top secret documents that were among the hoarded trove at Trump's Mar-a-Lago compound that Trump claims he declassified before he quietly removed them from the White House.
To date, no independent testimony has been presented to corroborate Trump's assertion. And despite his repeated insistence that he declassified some or all of the documents, Trump and his lawyers are declining to reveal specifics to Dearie.

"The Draft Plan requires that the Plaintiff disclose specific information regarding declassification to the Court and to the Government. We respectfully submit that the time and place for affidavits or declarations would be in connection with a Rule 41 motion that specifically alleges declassification as a component of its argument for return of property," Trump's counselors wrote.

"Otherwise," they continued, "the Special Master process will have forced the Plaintiff to fully and specifically disclose a defense to the merits of any subsequent indictment without such a requirement being evident in the District Court’s order."

If the orange spirochete has no document showing he declassified anything, he's toast. And since he did not own the classified docs in the first place, he's now burnt toast. Since we know that not even orange marmalade will cover up the taste of burnt toast, he can only be saved by being thrown to the sharks.

When Donald Trump flooded the federal bench with judicial appointments, a leading critique was that they were Federalist Society clones who favored muscular executive power and rejected what some perceive as meddling by the courts in executive branch affairs. Judge Aileen Cannon’s recent orders in the fight over the classified records the former president is accused of keeping at Mar-a-Lago have turned that perception on its ear.
The rulings were widely chastised by a wide array of legal experts, including many from the right, who noted how far out of the conservative judicial mainstream they were. Cannon, during her confirmation process in 2020, had included on her relatively-thin resume that she’d been a member of the right-leaning Federalist Society for a decade-and-a-half, since around the time she entered University of Michigan law school.
“It’s a bizarre posture,” said one former Trump administration official and attorney close to many Federalist Society leaders. “It’s a waste of time…How is a judge going to determine whether or not something will gravely injure the national interest? That’s not what their competence is.” To many conservative lawyers, Cannon’s orders–particularly her decision to put a hold on the criminal investigation against Trump while the document review is underway–smack of a deference to the former president that targets of national security-related investigations never receive.

“I’ve never, in 35 years, seen an order like that in a criminal case,” said Edward MacMahon Jr., a Virginia-based criminal defense attorney who has represented accused spies and terrorists. “Every espionage client I’ve ever had would really like to have had this judge and get a special master approved and slow down the process. It’d be very helpful.” The idea that a judge would try to halt a criminal investigation is particularly galling to lawyers who favor a strict separation of powers between the executive, judicial and legislative branches. “The power to investigate and prosecute rest wholly in the executive branch,” MacMahon said. “The judge has no authority to stick their nose into an investigation and stop the executive branch from doing what it’s doing.”

'Enough is enough': Legal expert explains how Judge Dearie bypassed the Trump judge’s poor rulings

Trump demanded a special master in the court, and even went so far as to ask for Judge Raymond Dearie. After the DOJ agreed to Dearie, Trump's legal team is refusing to cooperate ahead of the first meeting Tuesday afternoon.
He went on to say that he Trump will have to produce the affidavit that the documents were declassified to prove the documents could even be taken outside of the Oval Office, much less the White House.

It's the easiest way to prove that the documents aren't Trump's because there's no document proving it. The second battle that Trump's lawyers will have to fight to prove that Trump owned the documents, which will also be difficult since they were generated by the government for the government.

Dearie is a former US Atty and chief judge of the Eastern District of New York, which covers from Brooklyn east to the end of Long Island.
Andrew Weissmann, a federal prosecutor, a former senior member of special counsel Robert Mueller's team and a special master himself, described Dearie as "compassionate" and "fair" and the "platonic ideal of what you want in a judge."

"If you asked both prosecutors and lawyers, they would say the same thing, that he is just so fair," Weissmann said. "It's unusual to have a judge where both sides just have enormous praise for somebody." When Weissmann was starting out as a federal prosecutor in Brooklyn, the judge was late for a court appearance. "A few days later, I got in the mail a handwritten apology from him," Weissmann recalled. The defense lawyer got the same letter from the judge. "It was just remarkable because judges have a lot of power — they don't need to do that," Weissmann said.

And in a statement to NPR, Daniel R. Alonso, partner at Buckley LLP and a former assistant U.S. attorney in the Eastern District of New York, called Dearie an "old-school gentleman and unfailingly polite." "Judge Dearie is a judge who, though unfailingly fair, would never tolerate the kinds of arguments that Trump's lawyers tend to put forward," Alonso said.
In remarks to the New York Criminal Bar Association in 2016, he called for the criminal justice system to be "rethought and retooled significantly." "If society relies on the jail cell alone to bring relief to the streets of New York or Chicago, or to fight the heroin epidemic that has invaded our communities, little will change," he said, adding that he wondered "how we as a society would fare if we took a fraction of the money we spend on warehousing people and invested it in programs to reach those vulnerable to the hollow call of the streets." Dearie admitted that at times, he wanted "to scream out in frustration, sadness and anger" when he was required to impose a mandatory sentence.

I don't think this will play out like Trump and his lawyers planned, Dearie isn't a rubber stamp judge just because he was appointed by Reagan. Ultimately it will end up at SCOTUS and may be we'll get a clear reading on exactly when Executive Privilege ends.

Texas Attorney General Ken Paxton tells court not to trust Biden in Trump records case

Texas Attorney General Ken Paxton on Tuesday attacked the Biden administration in a federal court brief as part of a case involving the seizure of records from former President Donald Trump’s home in Florida.

Paxton, a Trump ally who has joined the former president in falsely claiming the 2020 election was marred by widespread voter fraud, filed a friend of the court brief in the 11th U.S. Circuit Court of Appeals. He argued the government under President Joe Biden cannot be trusted to act appropriately in the case involving Trump.

Paxton alleged, in a meandering nine-page argument, that the Biden administration has acted unethically in several cases. Those instances were largely policy differences, such as attempting to put in place a federal COVID-19 vaccine mandate, ending Trump-era immigration rules and extending a moratorium on evictions during the pandemic. Paxton also attacked the White House for its conduct unrelated to the federal courts or Trump, alleging that the administration sought to censor information about COVID-19 and also mislead the public about illegal immigration via the U.S.-Mexico border.

Trump's first day with the special master isn't going very well

After a conference call fiasco, Judge Raymond Dearie -- Donald Trump's hand-picked special master -- on Tuesday clashed with the president's lawyers over their refusal to answer questions from the court.

Dearie said that it isn't his role to determine whether or not the documents are classified, it belongs to the executive branch. He explained that when he looks at the case he sees "top secret" marked everywhere.

Dearie asked how he could dispute what the executive branch has indicated on the documents themselves and said that he isn't in a position to argue against it. So, he asked Trump's team what their proof was of declassification.

Trump's lawyers revealed Monday night that they didn't want to answer the judge's questions about classified information because they anticipate that the former president will be criminally indicted by the Justice Department. They have not indicated why they think an indictment is certain.

Trump paid key witness $7,500 only 11 days after Mar-a-Lago search

Trump has, for weeks — again and again, any time he spoke publicly — said that he declassified the more than 100 documents seized in the FBI search," Burnett noted. "But there's never been any evidence or anyone who has come to verify that and the special master is now saying that unless he receives any evidence to back up that claim that Trump is publicly making, he will consider all of the information marked classified to be classified."
Also on Tuesday, Trump's Save America PAC revealed a payment to Patel's consulting firm, Trishul LLC.

"Kash Patel makes his first appearance on Trump’s payroll — $7,500 on Aug. 19," Daily Beast correspondent Roger Sollenberger reported.

Grisham suggested Patel and others might publicly testify that Trump declassified the documents.
