"Firearms groups challenge California gun law modeled after Texas abortion ban"

Firearms groups have filed a widely anticipated legal challenge against a California gun law modeled after Texas’ vigilante antiabortion legislation. Gov. Gavin Newsom explicitly called out the Texas law in July when he signed Senate Bill 1327, which allows private citizens to sue the makers and distributors of firearms that are banned in California. The lawsuit filed Monday targets a provision — also modeled after the Texas legislation — that requires those challenging the state’s gun laws to pay legal fees if the challenge fails. Section 1021.11 of the Code of Civil Procedure, added by SB 1327, would make attorneys and plaintiffs seeking to challenge gun laws or restrictions “jointly and severally liable to pay the attorney’s fees and costs of the prevailing party.”

Plaintiffs including San Diego firearms dealer Gunfighter Tactical, the San Diego County Gun Owners PAC and the Second Amendment Foundation allege in their lawsuit that the statute regarding legal fees is unconstitutional and “seeks to suppress firearms-related litigation.”
The statute would take effect Jan. 1. In the complaint, the plaintiffs wrote that they are already challenging California’s ban on assault weapons. “Section 1021.11, however, forces Plaintiffs to litigate their assault-weapons challenge under the threat of a potentially ruinous fee award,” the plaintiffs said.

The plaintiffs allege that the provision on legal fees violates the 1st Amendment by singling out “firearms advocates’ protected activity and seeks to choke off their access to the courts.” “California adopted this fee-shifting scheme as a response to — and apparently in retaliation for — a similar fee-shifting scheme that Texas enacted in connection with abortion regulations,” the plaintiffs said in the complaint. “But tit-for-tat is not a rational or permissible justification for the classifications in this case.” SB 1327 was expected to draw numerous challenges from gun rights advocates after it was passed. The law would be invalidated if the Texas abortion law it is modeled after is also nulled.

That particular law is so blatantly anti constitutional it should have never been put on paper. Newsom is such a total fucking dickhead. I view him right up there with the likes of Abbot and desantis, just batting for the other side. Political whore doing anything for views, votes and Venmo.

Just like Biden, Trump and DeSantis, Newsom's running for president in 2024, but he can't say it at this time because of state and federal campaign laws so he dances around it. Hope this lawsuit was filed in the US District Court for the Southern District of CA where there is a chance of winning.

Coming to the conclusion that there is very little reason for me personally to vote for any dem candidate and very little reason to go to the polls at all. Keeping my hope up that there might be some greens to vote for, but that may be questionable as well.

Well if you can get rid of the Cal law then common sense dictates one should be able to get rid of the Texas law. Maybe thats the strategy eh?

It's early, we have the midterms to get through. Sometime next year there will be announcements of who is running in the presidential primaries. A lot can happen, Biden and Trump are elderly men and could have health problems, Trump has legal problems, scandals could hit other candidates or they could bomb in the polls, in fundraising or something we don't know anything about.

The last thing I want is for Trump to get reelected, he's a threat. If Biden doesn't run then it's an open field. One pundit I heard ranked the Democratic side as Biden, Newson, unknown candidate and Harris. On the Republican side he listed Trump, Cruz, Youngkin and DeSantis. I'm not happy with Newsom or Harris and wouldn't vote for them, so I hope there are choices like Roy Cooper (NC governor) or some other electable Democrats or it's third party or a blank.

In his defense, Gavin did say he did this knowing it's unconstitutional, doing it as a way to showcase how foolish TX was to sic private citizens on others for a bounty. I'm sure he'll make as much hay out of this as he can.

Yes, it's dumb and foolish and likely illegal. Any publicity is good publicity, eh?

Yup, even the talking heads on MSNBC realized that this could be done using the Texas law and other things as well before Gavin jumped on it.
Just waiting on some lawsuits.

And if many do the same thing on the Dem side, might as well reserve a spot on the National Mall in DC NOW for the desatan or trump inauguration....

The 2024 election is different. As far as 'gun regs'...I see that a lot of weird, dangerous, scary people have a lot of legally obtained guns.
I have a lot of guns, nobody is going to 'take them away'. Easy now and probably in the future, to be able to get any gun I want. I'm don't get sweated up about 'slippery slopes' or other 'sky is falling' type stuff that may or may not come to pass either here in VERY blue Colorado or nation-wide.

BUT, 2024 election is different..If you'd like to see what the US will be like if GOPathetic anybody is in the WH and/or in Congress..look at florida or texas.
Women, people of color, trans people, gay people, liberals in general...your rights WILL be threatened or taken away.
